REQUIREMENTS FOR RA 9255

What is R.A.  9255?

It is a law allowing illegitimate children to use the surname of their father provided that the father has acknowledge the child, amending Article 176 of Executive Order No. 209 (Family Code of the Philippines)

The law was signed by President Arroyo on 24 February 2004 and took effect on 19 March 2004, fifteen days after its publication in the Manila Times and Malaya.

The implementing  rules and regulations (IRR) was approved on 18 May 2004 and took effect on 02 June 2004, fifteen days days after its publication in the Manila Times.

Scope of R.A. 9255

The law applies to all illegitimate children born before or after the effectivity of R.A. 9255 which covers unregistered births and registered births wherein illegitimate children use the surname of their mother

WHAT IS REPUBLIC ACT 9048?

Republic Act (RA) 9048 authorizes the city or municipal civil registrar or the consul general to correct a clerical or typographical error in an entry and/or change the first name or nickname in the civil register without need of a judicial order.

RA 9048 amends Articles 376 and 412 of the Civil Code of the Philippines, which prohibit the change of name or surname of a person, or any correction or change of entry in a civil register without a judicial order.

President Gloria Macapagal-Arroyo approved the act on 22 March 2001. With the law taking effect on 22 April 2001, the Civil Registrar-General promulgated Administrative Order No. 1 Series of 2001, which was published in the newspaper in August that year.

WHAT CORRECTIONS CAN BE MADE BY RA 9048?

RA 9048 allows these corrections:

·  correction of clerical or typographical errors in any entry in civil registry documents, except corrections involving the change in sex, age, nationality and status of a person.

(A clerical or typographical error refers to an obvious mistake committed in clerical work, either in writing, copying, transcribing, or typing an entry in the civil register that is harmless and innocuous, such as a misspelled name or misspelled place of birth and the like, and can be corrected or changed only by reference to other existing record or records.)

·  change of a person's first name in his/her civil registry document under certain grounds specified under the law through administrative process.

WHAT ARE THE CONDITIONS UNDER RA 9048 THAT THE PETITIONER NEEDS TO COMPLY WITH?

(1) The petitioner finds the first name or nickname to be ridiculous, tainted with dishonor or extremely difficult to write or pronounce;

(2) The new first name or nickname has been habitually and continuously used by the petitioner and he has been publicly known by that first name or nickname in the community; or,

(3) The change will avoid confusion.

  • 2 latest certified/LCR copies and 2 latest NSO copies of birth certificate to be corrected.
  • 2 copies of baptismal certificate or confirmation certificate.
  • 2 copies of school records, Elementary, High School, College (form 137 or transcript of records).
  • 2 certified copies of voter’s registration records/voters affidavit.
  • 2 latest original NBI Clearance. (purpose: FOR CHANGE OF NAME).
  • 2 latest original PNP Clearance. (purpose: FOR CHANGE OF NAME).
  • 2 copies of valid ID of the petitioner and document owner and 1 copy of latest community tax certificate of the petitioner from the place of work or residence. (Cedula)
  • Other documents which the office may consider relevant and necessary for the approval of the petition.

(GSIS/SSS records, Medical Records, Business records, School records, Insurance, Land Titles, Certificate of Land Transfer, Bank Passbook… etc)

NOTE: All marriage contract, birth certificate and death certificates to be submitted should be latest certified copy when issued in Manila , if issued OUTSIDE Manila, Security Paper from NSO.

STEPS TO FOLLOW:

1. Submit all requirements to RA 9048 receiving table for the evaluation and initial interview. (Table 1&2) Please bring all the original documents and ID always.

  • Preparation of Petition Paper. (Table 3)
  • Final Interview. ( First come first serve basis)
  • Proceed to room 214, City Legal’s Office for notary.
  • Pay at the Tax Payer’s Lounge. For Registration fee P1,000, Certified true copy fee P230, Transmittal fee P210).
  • Receiving and filing of petition paper. Scheduling of follow-up. (Table 4).
  • After 45 working days, follow-up the status at the releasing area at WINDOW 3

  • 2 latest certified copies of birth certificate of at least 2 children of the document owner.
  • 2 copies of baptismal certificate or confirmation certificate.

2 latest certified/LCR copies and 2 latest NSO copies of birth certificate to be corrected. 
2 latest certified copies of birth certificate of all brother and sister of document owner. 
2 latest certified copies of Obstetrical record, Medical record and Pre-natal record from the hospital and/or OB Gyne. 
2 copies of any insurance of parents where all their children are their beneficiary which also arranged accordingly (SSS, GSIS, BIR, PHILHEALTH, PAG IBIG …etc). 
2 copies of valid ID of petitioner and document owner (baby book if infant) and 1 copy of petitioner’s Community Tax Certificate from the place of birth or residence. 
Other documents the office may consider relevant and necessary for the approval of the petition.

Note:

1. During the interview, the owner of the document or Mother or Father for legitimate children will sign the supplemental report. If the child is illegitimate the mother will sign the supplemental form.

2. In case both parents are deceased, submit death certificates of both parents and the affidavit of guardianship. The grandmother can sign the affidavit.

Latest Certified Copy of Birth Certificate of the Child. Include dorsal page if signed by father.

Original school Records showing the names of the parents. 
Both Parents must come for interview. (by schedule) 
If mother is deceased, submit Certified Copy of Death Certificate (Latest Copy). 
If child is of legal age (18 yrs. Old and above)

5.3 Income Tax Return of the father where the child is declared as beneficiary 

5.4 Philhealth of the father where the child is declared as beneficiary 

5.5 Insurance of parents where the child is declared as beneficiary 

5.6 Report card or Form 137 of the child wherein the name of the father is declared or the signature of the father is affix at the card. 

5.7 Statement of assets and liabilities 

6. If mother is deceased, submit the Latest Certified True Copy of Death Certifiacate 

7. If father is deceased, AUTHENTIC WRITING WILL BE NEEDED. SUBMIT THE FOLLOWING DOCUMENTS LISTED AT NUMBER 5 AND THE ID OF THE FATHER. 

8. Submit photocopy of the valid ID and Cedula of the parents.

APPEARANCE OF PARENTS (FATHER AND MOTHER) ON THE SCHEDULE OF INTERVIEW AND BRING THE ID AND CEDULA FOR VERIFICATION. IF CHILD IS OF LEGAL AGE (18 YEARS OLD AND ABOVE) APPEARANCE FOR INTERVIEW IS NEEDED AS WELL AS ID AND THE CEDULA.
